Mrs. X, a 34-year-old housewife with three children, was referred to TIP for legal representation from one of our partners a Ireti Resource Center, to address a family dispute. Mrs. X reported enduring a range of abuses, including physical, mental, and emotional abuse from her husband, who frequently returned home intoxicated and subjected her to abuse in the presence of their children and has also stopped providing maintenance for the household for over two years. Several attempts at resolving the matter via mediation failed, and the husband instituted an action against Mrs. X, praying the court for custody of the three children and an order directing Mrs. X to leave their apartment to another unidentified rented apartment.
TIP represented Mrs. X as her attorney in court and countered the application by her husband. The Court delivered its judgment on June 22, 2023, denying the prayers sought by her husband and held that Mrs. X should continue to live with her children in their matrimonial home free from harassment. The Court also ordered her husband to provide a monthly allowance from January 2022 for essential needs such as upkeep, food, clothing, and medical support for the children and pay the three children’s fees until the end of their university education.
